Welcome to Zenith Capital Group (“Zenith,” “we,” “us,” or “our”). These Terms of Service (the “Terms”) govern your access to and use of the Zenith website, applications, and related services (collectively, the “Service”), including any version served at tradingappx.com, zenith-capital-group.com, or related domains.
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
1.What Zenith Is — and Is Not
Zenith is a 100% simulated, paper-trading environment. It lets you and automated strategies place hypothetical trades across stocks, cryptocurrencies, options, futures, and crypto options using a virtual cash balance. Every account starts with simulated funds; no real money is ever deposited, held, withdrawn, transferred, or at risk.
- Zenith is not a broker-dealer, investment adviser, futures commission merchant, exchange, money transmitter, or financial-services firm.
- Zenith does not execute real orders, custody real assets, or hold real funds, and is not affiliated with any registered investment adviser or any similarly named company.
- All balances, positions, trades, profits, losses, win rates, and performance figures shown in the Service are hypothetical and simulated.
2.No Investment, Financial, Legal, or Tax Advice
The Service — including any AI-generated commentary, trade journals, signals, model outputs, screeners, backtests, leaderboards, educational content, or market data — is provided for informational and educational purposes only. Nothing in the Service constitutes, or should be construed as, investment, financial, legal, accounting, or tax advice, a research report, or a recommendation, offer, or solicitation to buy or sell any security, derivative, cryptocurrency, or other asset.
You are solely responsible for any real-world financial decision you make. We strongly encourage you to consult a licensed professional before making any actual investment.
3.Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that your use complies with all laws applicable to you.
4.Your Account
To use most features you must register an account. You may sign in with an email and password, with a Google account, or with a passkey (WebAuthn). You agree to:
- Provide accurate, current information and keep it up to date;
- Keep your credentials confidential and not share your account;
- Be responsible for all activity that occurs under your account; and
- Notify us promptly of any unauthorized use.
New email/password accounts must verify their email address before automated or manual trading is enabled. We may refuse, suspend, or reclaim usernames, and may suspend or terminate accounts that violate these Terms.
5.Simulated Trading, Virtual Balances & Resets
Virtual balances and simulated positions have no monetary value, cannot be redeemed, withdrawn, transferred, or exchanged for anything of value, and are not your property. You may operate one or more simulated portfolios. We may, and you may, reset, archive, or recalculate portfolios, balances, or performance history — for example to correct data errors, fix bugs, rebalance starting capital, or maintain the integrity of the simulation and leaderboards. We are not liable for any change to, or loss of, simulated balances, positions, or history.
6.Public Leaderboard & Display Name
The Service includes a public leaderboard. If your account is eligible, your display name (or username if no display name is set) and your simulated performance metrics — such as profit/loss, win rate, trade count, top strategy, drawdown, and member-since date — may be shown publicly and ranked against other users. Choose a display name that does not reveal information you wish to keep private. Accounts with no activity for 30 days are automatically hidden from the leaderboard, and you can remove yourself by deactivating or closing your account (see Section 13).
7.Subscriptions, Billing & Cancellation
Zenith offers a free tier and an optional paid Premium subscription that unlocks additional features (such as all asset classes, AI trade journals, the risk lab, and expanded tooling). Premium is currently offered at $10 per month or $90 per year (USD). The price, billing interval, and any applicable taxes shown at checkout are controlling.
- Payment processing. Subscriptions are billed through Stripe, and your payments are also subject to Stripe’s terms. We do not collect or store your full payment-card details; Stripe handles card collection and processing under its own terms and privacy policy.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until canceled.
- Cancellation. You may cancel anytime from the in-app billing portal. Cancellation stops future renewals; your Premium access continues until the end of the current paid period.
- Refunds. Except where required by law, payments are non-refundable and partial periods are not pro-rated.
- Price changes. We may change subscription pricing or features prospectively; changes will not affect the period you have already paid for, and material changes will be communicated before they take effect.
8.Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or abusive purpose, or in violation of these Terms;
- Attempt to gain unauthorized access to any account, system, or data, or probe, scan, or test the vulnerability of the Service;
- Interfere with or disrupt the Service, impose an unreasonable load, or circumvent rate limits, security, or access controls;
- Scrape, harvest, or systematically extract data, or use bots to manipulate the leaderboard or simulation;
- Reverse engineer, decompile, or resell the Service except to the extent permitted by law;
- Upload or transmit malicious code, or content that is unlawful, infringing, harassing, or otherwise objectionable.
9.User Content
You may submit content such as trade notes, journal entries, support tickets, and a display name (“User Content”). You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and use your User Content as needed to operate, secure, and improve the Service. You are responsible for your User Content and represent that you have the rights to submit it. Do not submit sensitive personal information (e.g., government IDs, financial-account numbers) in free-text fields.
10.AI-Generated Content
Some features generate explanations, “trade journals,” or rationales using artificial-intelligence models provided by a third-party AI provider (Anthropic, via the Claude API). To produce these, details about your simulated trades and positions may be sent to that provider. AI output can be incomplete, inaccurate, or misleading, is generated automatically, is not reviewed by a human, and is provided for educational purposes only. Do not treat AI output as advice and do not rely on it for real-world decisions.
11.Market Data
The Service uses market and reference data obtained from third-party sources (including Yahoo Finance, Deribit, NewsAPI, Alpha Vantage, and Finnhub). Such data may be delayed, incomplete, inaccurate, or unavailable, and is provided “as is” without warranty. We and our data providers are not liable for any reliance on this data. Third-party data is subject to the rights of the respective providers and is provided for personal, non-commercial use within the simulation.
12.Third-Party Services
The Service integrates third-party providers — including Stripe (payments), Google (sign-in), our AI provider (trade journals), market-data sources, email delivery, and infrastructure/CDN providers. Your use of those features may be subject to the third party’s own terms and privacy practices. We are not responsible for third-party services. See our Privacy Policy for details on what data is shared with whom.
13.Account Deactivation, Closure & Inactivity
You may deactivate your account at any time (reversible by logging back in) or permanently close it from your account settings. When you close your account, we scrub identifying profile details and prevent future sign-in; however, we may retain certain records (including simulated trade and portfolio history in de-identified form) as needed for security, integrity, auditing, and legal compliance. Accounts that remain inactive for 30 days may have automated trading paused and may be hidden from the leaderboard.
14.Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DATA, MODEL OUTPUT, OR SIMULATED RESULT WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ZENITH OR ITS OWNERS, OPERATORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR INVESTMENT LOSSES (INCLUDING REAL-WORLD TRADING LOSSES), ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.
16.Indemnification
You agree to indemnify and hold harmless Zenith and its owners, operators, and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.
17.Changes to the Service and These Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above and, for material changes, provide reasonable notice — for example by email and/or an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
18.Governing Law & Dispute Resolution
These Terms are governed by the laws of the United States and, to the extent applicable, the state in which Zenith Capital Group is established, without regard to conflict-of-laws rules. You agree that the courts located in that jurisdiction will have exclusive jurisdiction over any dispute that is not otherwise subject to an alternative resolution process, and you consent to personal jurisdiction there. To the extent permitted by law, any dispute will be resolved on an individual basis, and you waive any right to participate in a class action.
19.Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
